Right of Withdrawal & Cancellation Policy

This policy explains the difference between:

  1. the statutory right of withdrawal that may apply after purchasing coaching at a distance; and
  2. cancelling an ongoing coaching agreement.

Nothing in this policy is intended to limit mandatory consumer rights.

2. Statutory Right of Withdrawal

If you are a consumer and you enter into an agreement with Sjakie Calisthenics at a distance, for example online, by telephone or through another distance communication method, you may have a statutory right to withdraw from the agreement within 14 days without giving a reason.

The withdrawal period generally starts on the day the agreement is concluded.

To exercise your right of withdrawal, you must inform us clearly of your decision to withdraw.

You may also use the standard withdrawal form provided below. Use of the form is optional.

3. Immediate Start of Coaching During the Withdrawal Period

Sjakie Calisthenics may offer Clients the possibility to start coaching immediately after purchase.

The coaching service may include:

  • access to the coaching application;
  • training programs;
  • digital training content;
  • personal coaching;
  • form checks;
  • feedback;
  • communication and support.

If you request that the coaching service begins during the statutory withdrawal period, specific legal rules may apply.

Where required by law, we will ask you to make the appropriate express request, consent and acknowledgement before the service begins or before digital content or digital services are supplied.

4. Services Already Provided During the Withdrawal Period

If you exercise a valid right of withdrawal after expressly requesting that the coaching service begin during the withdrawal period, you may be required, where permitted by applicable law, to pay a proportionate amount for services actually provided before you notified us of your withdrawal.

The amount will be assessed in accordance with applicable law and the agreed value and scope of the services provided.

For example, relevant factors may include:

  • the period during which coaching services were actively provided;
  • personalised coaching work completed;
  • feedback provided;
  • form checks completed;
  • other personal coaching services actually performed.

Any amount charged will not exceed what is legally permitted.

5. Digital Access

Parts of the coaching service may involve digital content or digital services, including access to:

  • the coaching application;
  • training programs;
  • educational materials;
  • digital coaching tools.

Where the law allows the statutory right of withdrawal to be lost or limited because digital content or digital services are supplied immediately, this will only apply where all legally required conditions have been met.

Sjakie Calisthenics will therefore request the required express consent and acknowledgement where applicable.

If the legally required conditions have not been met, your statutory rights remain unaffected.

6. Refunds Following a Valid Withdrawal

Where you validly withdraw from the agreement, any refund will be handled in accordance with applicable law.

Where legally applicable, Sjakie Calisthenics may deduct or retain an amount corresponding to services properly provided before the withdrawal request, provided that the legally required conditions for doing so have been met.

Refunds will otherwise be processed using the applicable legal rules.

7. Cancelling During the Initial 12-Week Commitment

The coaching agreement has an initial minimum commitment period of 12 weeks.

You may notify us that you wish to stop participating during this period.

However, subject to mandatory consumer law and any applicable statutory withdrawal or termination rights, ending participation early does not automatically remove your payment obligations for the agreed initial 12-week commitment.

If you have chosen to pay in instalments every 4 weeks, those instalments are part of the agreed payment arrangement for the initial 12-week commitment.

8. Cancelling After the Initial Commitment Period

After the initial 12-week commitment period, the coaching agreement continues for an indefinite period unless ended.

You may cancel at any time after the initial commitment period with a maximum notice period of one month.

Please clearly state that you wish to cancel your coaching agreement.

We will confirm receipt of your cancellation.

9. Automatic Payments

Where recurring payments have been agreed, payments may continue automatically in accordance with the agreed payment schedule until the agreement is validly cancelled.

The exact payment amount and frequency are agreed individually with the Client before purchase.

Cancelling an automatic payment method with your bank or payment provider does not automatically cancel your contractual obligations.

To cancel the coaching agreement, you must notify Sjakie Calisthenics.
