1. Who we are and what these Terms cover
These Terms of Service ("Terms") are a binding agreement between you and Sjakie Minet, trading as CaliRealm (eenmanszaak, KvK 93183208, VAT NL005003670B69, registered at Amnestylaan 145, 4336 LL Middelburg, Netherlands) ("CaliRealm", "we", "us").
They govern your use of the CaliRealm app (at app.calirealm.com, in the browser or installed on your device), the CaliRealm pages at calirealm.com, and related services (the "Service"). By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 16 years old to use the Service and have the legal capacity to enter into these Terms. By using the Service you confirm that you meet these requirements.
3. What CaliRealm is, and what it is not
CaliRealm is a calisthenics training service. It includes:
- Training programs. Structured multi-week programs, including programs generated and adapted for you from the information you give us (such as your level, schedule, and what you actually completed). Programs roll forward week by week and change in response to your logged training.
- Workout tracking. A workout player that guides you through each set, logs your sessions, and stores your training history.
- Camera tracking. Using your device camera and computer-vision pose analysis, the Service counts your repetitions and times your holds while you train.
- Form feedback. Automated, informational feedback on your technique, generated by AI from recordings or frames of your sets (see §12 and the Privacy Policy).
- Ranks, levels, streaks, and leagues. A progression system in which you earn skill ranks and experience points, maintain weekly streaks, and are placed into periodic competitive leagues against other users.
- Community features. A community feed and forum, friend connections, and leaderboards.
- Notifications. If you enable them, we send push notifications for things like rest timers, workout reminders, streak warnings, and community activity. You can turn these off at any time in the app or in your browser or device settings.
Some of what you do is public to other users. Your display name, avatar, rank, level, streak, league standing, and the progress that feeds them appear on leaderboards, league tables, and your public profile, visible to other users of the Service. Anything you post to the community feed or forum is visible to other users. Do not put information in your display name, profile, or posts that you are not willing to show publicly. See §6 and §7.
CaliRealm is a fitness and training tool, not a medical or healthcare service. It is:
- not a medical device, and not intended to diagnose, treat, cure, prevent, or monitor any disease, injury, or health condition;
- not a substitute for professional coaching, medical advice, physiotherapy, or supervision;
- powered by automated analysis and AI that can be wrong, incomplete, or delayed. Pose detection has limits, especially with occluded limbs, poor lighting, or non-lateral camera angles. Repetition counts, hold times, and the ranks and progress derived from them may be inaccurate, and generated programs are suggestions, not prescriptions.
Always use your own judgement. Do not rely on the Service as your sole source of guidance for risky movements.
4. Health, safety, and assumption of risk
Read this carefully. Calisthenics static holds, especially advanced skills like planche, handstand, and front lever, carry a real risk of serious injury.
By using the Service you acknowledge and agree that:
- You voluntarily assume all risks associated with training and with following or not following the Service's feedback, including risk of injury.
- You should consult a physician before beginning or changing any exercise program, particularly if you have any injury, medical condition, are pregnant, or are unsure whether an activity is safe for you.
- You will train within your own ability, warm up appropriately, use adequate space and safety precautions, and stop immediately if you feel pain, dizziness, or discomfort.
- AI feedback may be incorrect or mistimed; you must not perform a movement you believe is unsafe just because the Service suggests it, and the absence of a correction does not mean your form is safe.
If you do not accept these risks, do not use the Service.
5. Your account
You create an account with an email address and password, or by signing in with Google or Apple. You are responsible for your account credentials and for activity under your account. Use a strong password, keep it confidential, and tell us promptly at info@calirealm.com if you suspect unauthorised use. You must provide accurate information and keep it current. One person, one account.
6. Camera, recordings, and your content
"Your Content" means everything you create in the Service: hold and set recordings, and anything you post publicly: community and forum posts, comments, your display name, avatar, and profile text.
- The camera features require camera access. Recording and saving your sets are optional and controlled by you in the app.
- You retain ownership of Your Content. For recordings and training data, you grant us a limited licence to process and store them to provide the Service to you (analysis, feedback, tracking, and review), as described in the Privacy Policy.
- For content you post publicly (community and forum posts, comments, and profile content), you additionally grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content within the Service so we can show it to other users. This licence exists so the community features can work; it ends when you delete the content, except for copies we must keep for legal reasons or in backups until they expire.
- We do not claim ownership of Your Content, do not use it for advertising, and do not use it to train third-party AI models on an identifiable basis.
- You are responsible for ensuring you have the right to record any location and any other person who appears in Your Content, and for complying with local recording laws.
- You are responsible for what you post. Only post content you have the right to post, and remember that posts, your display name, and your leaderboard progress are visible to other users (§3, §7).
- You can delete Your Content and your account at any time.
6a. Moderation
We may review, moderate, remove, or restrict access to any content posted to the community, forum, or profiles, and may suspend or remove accounts, where we reasonably consider the content or conduct breaches §7, is unlawful, or harms other users or the Service. We may act on user reports or on our own initiative.
We are not obliged to monitor everything posted, and we do not pre-screen posts. Where we remove your content or restrict your account, we will, where required by applicable law, give you a statement of reasons and a way to contest the decision. Contact info@calirealm.com. Content posted by other users is theirs, not ours; we do not endorse it, and you rely on it at your own risk. You can report content through the in-app reporting tools or the contact address above.
7. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in breach of these Terms;
- upload content that is illegal, infringing, or that depicts a person who has not consented to being recorded;
- attempt to reverse-engineer, scrape, overload, or interfere with the Service or its security, except where such restriction is prohibited by law;
- resell, sublicense, or commercially exploit the Service without our written permission;
- misuse the AI features (e.g. to extract the underlying model or generate content unrelated to your training).
7.1 Community rules
The community feed, forum, comments, profiles, and display names are shared spaces. When you post, you agree not to post content that:
- harasses, bullies, threatens, or attacks another person, or incites others to;
- is hateful or discriminatory on the basis of race, ethnicity, national origin, religion, disability, age, sex, sexual orientation, or gender identity;
- is sexually explicit, or sexualises any person appearing in it;
- depicts or encourages self-harm, disordered eating, or unsafe weight practices;
- gives medical, injury-rehabilitation, or nutritional advice presented as professional guidance, or promotes performance-enhancing or other regulated substances;
- is spam, advertising, a scam, or promotion of an unrelated product or service;
- impersonates another person, or misrepresents your identity or affiliation;
- discloses another person's private information without their consent;
- infringes anyone's intellectual property or other rights; or
- is otherwise unlawful.
Do not use your display name, avatar, or profile to do any of the above, and do not manipulate ranks, leagues, streaks, or leaderboards, for example by falsifying training data, using multiple accounts, or exploiting bugs in the tracking or scoring system.
We may suspend or terminate accounts that breach this section, and remove content under §6a.
8. Subscriptions, billing, and renewals
8.1 Plans and price
The Service is offered on a free tier and paid subscription plans (monthly and yearly) described at the point of purchase. The price, billing period, and features shown at checkout apply. Prices include VAT where applicable.
8.2 Free trial
A paid plan may start with a free trial, with the trial length shown at checkout (currently 7 days on the yearly plan and 3 days on the monthly plan). A payment method is required to start the trial, and the plan's price is charged automatically when the trial ends unless you cancel before then. We remind you by email three days before the first charge. Cancelling during the trial costs nothing.
8.3 Billing rail
Payment is processed by Stripe. Purchases are made on the web — not through an app store — so your subscription is managed in the app (Settings → Membership), which opens Stripe's secure billing portal.
8.4 Auto-renewal
Subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date. We send renewal reminders where the law requires them.
8.5 Cancellation
You can cancel at any time in the app via Settings → Membership, which opens the billing portal. Cancellation stops the next renewal; you keep access until the end of the current paid period. We do not provide pro-rata refunds for partial periods except where required by law.
8.6 Price changes
We may change subscription prices. We will give you advance notice and the change will apply from your next billing period; if you don't accept it, you can cancel before it takes effect.
9. Right of withdrawal (EU consumers) and refunds
If you are a consumer in the EU, you have a statutory right to withdraw from your purchase within 14 days of entering into the subscription, without giving a reason.
Immediate access waiver. Because the Service is digital content/services supplied immediately, by starting to use the paid Service during the 14-day period you: (a) expressly request that we begin performance immediately, and (b) acknowledge that you lose your right of withdrawal once the service has been fully performed, and that for the part already supplied you may be charged a proportionate amount.
To withdraw, contact info@calirealm.com within the period. Outside the withdrawal right, refunds are at our discretion or as required by applicable consumer law or app-store policy. Nothing in these Terms limits your mandatory statutory consumer rights.
10. Early access and evolving service
Early access. While the Service is in early access, creating an account may require an invite code, and we may limit or stage who can join. This does not affect anyone who already has an account.
Parts of the Service are in beta. They may be incomplete, change, or be withdrawn, and may contain bugs. Beta features are provided "as is," and we may modify or discontinue features. We will not remove a paid feature you are actively paying for without offering a remedy consistent with your consumer rights.
11. Intellectual property
The Service, including its software, models, design, text, and branding, is owned by CaliRealm or its licensors and protected by IP laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial training. We reserve all rights not expressly granted.
12. Third-party services
The Service relies on third parties: Supabase (data and storage), OpenAI (AI feedback), Stripe (payments), PostHog (analytics, with your consent), Resend (email), Vercel (hosting), and Google and Apple (sign-in, if you choose it). Your use may be subject to their terms, and we are not responsible for their acts or omissions beyond our obligations under applicable data-protection law and these Terms.
13. Disclaimers
To the maximum extent permitted by law, and except for the warranties that cannot be excluded under mandatory law (including consumer law):
- the Service is provided "as is" and "as available" without warranties of any kind;
- we do not warrant that feedback will be accurate, that the Service will be uninterrupted or error-free, or that it will achieve any particular training result;
- we do not warrant that the Service prevents injury.
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by our intent or gross negligence, for fraud, or your mandatory statutory consumer rights.
14. Limitation of liability
Subject to §13 (we do not exclude liability that the law does not allow us to exclude):
- We are not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill, arising from your use of the Service.
- We are not liable for injury or loss resulting from your own training choices, pre-existing conditions, environment, or failure to follow §4 (Health and safety), except to the extent caused by our intent or gross negligence.
- To the extent we may lawfully limit liability, our total aggregate liability for any claim arising out of the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) €100.
Some jurisdictions do not allow certain limitations; in those places, the limitations apply only to the extent permitted.
15. Indemnity
To the extent permitted by law, you agree to indemnify us against third-party claims arising from your misuse of the Service, your breach of these Terms, or content you record that infringes someone else's rights, except where the claim arises from our own wrongdoing. This does not apply to you acting as a consumer beyond what the law allows.
16. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, to comply with law, or to protect the Service or other users. Where you are a paying consumer, we will act proportionately and, where required, give notice and a refund for any prepaid period you can no longer use. Sections that by nature should survive (e.g. §§11, 13, 14, 15, 18) will survive termination.
17. Changes to these Terms
We may update these Terms. For material changes, we will give reasonable advance notice (in-app or by email). If you continue using the Service after the changes take effect, you accept them; if you don't agree, you may cancel and stop using the Service.
18. Governing law and disputes
These Terms are governed by the laws of the Netherlands, without prejudice to the mandatory consumer-protection rules of your country of residence if you are an EU consumer. Disputes will be submitted to the competent Dutch courts, again without removing your right, as a consumer, to bring proceedings in your country of residence where the law gives you that right.
EU consumers may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
19. Miscellaneous
- If any provision is held unenforceable, the rest remain in effect.
- Our failure to enforce a provision is not a waiver.
- You may not assign these Terms without our consent; we may assign them to a successor of the business.
- These Terms and the Privacy Policy are the entire agreement between us regarding the Service.
